1. Introduction & Acceptance of Terms

Welcome to The Gift Library. These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (the “User,” “Customer,” or “Visitor”) and The Gift Library, a unit of websgram, a registered partnership firm based in Delhi, India (“we,” “us,” or “our”).

By accessing our website Thegiftlibrary.websgram.in, creating an account, or purchasing our products (including but not limited to customized gifts, Instagram viral products, neon signs, laser-cut products, and printing services), you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our website and services.

2. Eligibility

To use our website and make purchases, you must be at least 18 years of age or accessing the site under the supervision of a parent or legal guardian. By agreeing to these Terms, you represent that you are of legal age to form a binding contract under the Indian Contract Act, 1872.

3. Products & Accuracy of Display

We strive to display the colors, features, and details of our products (such as RGB galaxy lamps, wooden shadow boxes, and acrylic neon signs) as accurately as possible. However:

  • Color Variations: We cannot guarantee that your device’s display of any color will perfectly reflect the physical product.

  • Handcrafted & Natural Materials: Products made from MDF, wood, or acrylic may have minor variations in grain, texture, or finish due to the manufacturing and laser-cutting process. These are not considered defects.

  • Modifications: We reserve the right to modify or discontinue any product, category, or service without prior notice.

4. Customization & User-Generated Content

A significant portion of our business involves creating personalized products (e.g., customized mugs, Spotify frames, corporate flex banners, and custom neon signs). By uploading any content (text, photographs, logos, quotes, or artwork) for customization, you agree to the following:

  • Ownership & Rights: You confirm that you own the rights to the uploaded content or have the legal permission to use it. We are not liable for any copyright or trademark infringement arising from the artwork or logos you provide.

  • Prohibited Content: You may not upload content that is illegal, defamatory, obscene, highly offensive, or promotes violence/hate speech. We reserve the right to refuse and cancel any order that violates this policy.

  • Production Tolerances: Custom printing (sublimation, UV printing, laser engraving) involves technical processes. Slight variations in color matching, alignment, and sizing between the digital preview and the final physical product may occur.

5. Pricing, Taxes & Payments

  • All prices displayed on the website are in Indian Rupees (INR).

  • GST: Unless stated otherwise, prices are inclusive of the applicable Goods and Services Tax (GST).

  • Payment Gateways: We use secure, RBI-approved third-party payment gateways (e.g., Razorpay, PayU, UPI). We do not collect or store your banking/card details.

  • Price Changes: Prices for our products are subject to change without notice, but changes will not affect orders that have already been confirmed.

6. Shipping & Delivery

  • We ship across India from our operational base in Delhi.

  • Estimated delivery timelines are provided at checkout. Please note that customized products (e.g., neon signs, laser-cut plaques, bulk printing) require an additional 7 Days business days for production before they are dispatched.

  • We are not responsible for delays caused by third-party logistics partners, unserviceable pin codes, or force majeure events (e.g., natural disasters, strikes).

7. Cancellations, Returns & Refunds Policy

In compliance with the Consumer Protection (E-Commerce) Rules, 2020, our policy is structured based on the type of product you purchase:

A. Customized & Personalized Products

Because these items are made specifically for you with your name, photo, or logo, customized products cannot be cancelled, returned, or refunded once production has begun.

  • Pre-Production Cancellations: If you wish to cancel a customized order, you must do so within 1hour of order placement by contacting our support team. Once the design is sent to our printing/laser-cutting machines, cancellation is not possible.

  • Defective Custom Items: If your custom product arrives damaged, broken, or with a clear manufacturing defect, you must report it to us within 48 hours of delivery with unboxing video/photos. We will provide a free replacement.

B. Standard/Non-Customized Products

(e.g., Instagram viral gadgets, standard retro gaming machines, uncustomized LED decor).

  • Returns: You may initiate a return for standard products within 3 days of delivery if the item is unused, in its original packaging, and has all tags intact.

  • Refunds: Once the returned item is received and inspected, approved refunds will be credited to your original payment method within 5 to 7 business days.

8. Intellectual Property Rights

All content on this website—including the “The Gift Library” brand name, websgram logos, website design, product images, graphics, and text—is the exclusive property of The Gift Library and is protected by Indian copyright and trademark laws. You may not copy, reproduce, or use our content for commercial purposes without explicit written consent.

9. Limitation of Liability

To the maximum extent permitted by law, The Gift Library and websgram shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill) arising from your use of our website, the delay/inability to use our services, or the purchase of our products.

10. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and constructed in accordance with the laws of India. Any disputes arising out of or related to these Terms, your use of the website, or product purchases shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer to handle customer complaints regarding our products, services, or policies.
